Establishing Association Rules

Community association living is a lifestyle and it is a choice. The problem is, not all associations are created equal and many members do not read and/or understand their governing documents. Establishing rules that balance architectural uniformity with a desire for personal expression is an ongoing challenge for any association. The way in which you approach rule making and breaking – will speak volumes about the spirit of your association. To set the right tone, remember these key points:

There must be a need for the rule.

Sounds simple, but how many times is a rule put in place because one set of neighbors can’t get along or someone’s grandchild acts up at the pool? Members don’t want their neighbor to know who is making a complaint so they pressure the association to intervene. Ask yourself if the issue at hand warrants the establishment of a community wide rule. Could a private conversation or carefully written letter of inquiry from the association better serve the situation?

Never adopt a rule under pressure.

Take time to think things through and look at the situation from all angles. Try to predict the consequences of any rule you want to establish. If it’s December 1 and you don’t have your holiday decoration guidelines in place, wait until next year and use this year as a learning experience. Consider soliciting input from the membership. What do they consider reasonable, based on the decorations being displayed?

Rules must be enforceable.

If you are not willing to enforce a rule unilaterally and consistently, don’t bother adopting it. You’ll only spread ill will and expose the association to potential discrimination lawsuits.

Base rules on proper authority.

Create rules that are consistent with existing federal, state and local laws as well as your own governing documents. If you not sure if you have the power to make a rule, consult with the association’s attorney.

Rules should be reasonable.

The object of any rule is compliance. The vast majority of your community should be more than willing to abide by the rule.

 Rules should be simple to understand.

State its purpose clearly and concisely. Make a rule easy to understand by avoiding legal sounding terms. Consider this example: “No signs placed by unit owners or persons other than the association, window displays or advertising, except for the name plate or sign, not exceeding nine square inches in area, on the main door to each unit and on each mailbox, with the unit number in a form approved by the association, will be maintained or permitted on any part of the common-interest community or any unit.” Huh? Simply restated, this rule says: Residents may not place signs on the common areas or in their windows; however, they may place signs that do not exceed nine square inches on their front door or mailbox.

Adopted rules should be published.

Once adopted, distribute the rule to the membership. Be sure to include the date the rule was adopted as well as the date the rule becomes effective.

Turnberry Residents:

PET OWNERS  Please keep your dog leashed at all times when outside of your home and bring your Fido bag to cleanup after pet.  We are asking that the community remain nice, clean and green.The landscape areas are not be used as a “doggy bathroom” if you are walking your dog.  We want to keep these areas nice for everyone to enjoy and as a courtesy to our gardeners who have to mow the areas. Thank you for respecting your community.

COMMUNITY CARE  As a reminder, Community Care; Action Property Management is available to you from 7 am to 7 pm Monday through Friday and after hours on emergency calls; (949) 450-0202 or (800) 400-2284.  We encourage our homeowners to call the center for service and assistance.  The Community Care Center is there to help with work orders, and routing calls to the correct departments at Action Property Management.

Just create an account at www.vivoportal.com and you will be able to get Insurance information, Budget, Audit, Minutes, CC&R’s, Assessment and Collection Policy, Rules and Regulations, Forms, and account information. You can also create and see updates on work orders for your property and pay your dues online.


November 2017 Managers Message

Happy Holidays Turnberry Homeowners Association ~

Decorate and entertain during the holiday season with caution and keep safety in mind. According to the U.S. Fire Administration, during Thanksgiving approximately 2,000 house fires happen with 69 percent of the fires caused by cooking. During the holidays, an estimated 128,700 fires and 1,650 injuries, along with 415 deaths occur with close to $25.5 million in property damage.

Paul Davis Restoration, Inc. a national franchise company and provider of fire, water and mold damage restoration services for residential and commercial properties, offers the following tips to make the holidays safe for you and your family.

Holiday decorations: Be aware of toxic decorations which may be poisonous. Use non-combustible, flame-resistant materials. Never use lighted candles on a tree, evergreens or other flammable materials.

Lights: Check for loose connections, broken or cracked sockets or frayed wires. Use UL-approved lighting. Fasten lights to the tree and prevent bulbs from coming in contact with the needles or branches. Turn off all holiday lights when leaving home or retiring for the evening.

Trees: Be sure a natural tree is fresh and less likely to become a fire hazard. Cut two inches off the trunk and place in a sturdy water stand, water daily. Keep the tree away from fireplaces, wall furnaces and other heat sources. Use ‘fire resistant’ artificial trees.

Portable space heaters: Place space heaters at least three feet away from anything combustible and operating only when you are in the room. Don’t leave a space heater on overnight or near children and pets.

Cooking: Avoid wearing loose clothing which can be ignited by hot burners. Turn pot handles in. Don’t store items on top of the stove, they can catch on fire. Turn off kitchen appliances after use. Turkey fryers should be used outdoors and away from buildings and flammable materials.

Fire escape plan: Know your escape routes. Have a working fire extinguisher in the kitchen, laundry room, and garage. Never burn greens, papers, or other decorations in the fireplace. Working smoke alarms should be installed on every level of your home, test them monthly, replace batteries every six months.

Know who to call in case of an emergency: Keep contact numbers handy for the police and fire departments, doctors and the national poison help line. In case of emergency property damage, contact a licensed, professional fire damage clean-up and restoration company.

September 2017 Managers Message

THE BASICS OF LIVING IN AN HOA:  Your community is a non-profit, mutual benefit corporation registered with the State of California. As such, it is managed by a Board of Directors whose purpose is to oversee the maintenance and operations of all common areas and facilities.  The Board is also responsible for governing your community in accordance with the provisions of the CC&Rs, Bylaws, and the Articles of Incorporation.

Maintaining and operating your Common Areas and facilities requires funding and these funds are collected from you in the form of monthly assessments. In addition, these monies provide for a reserve fund, as recommended in annual reserve studies performed, to offset future capital expenses. Your monthly assessment is due on the first day of each month in conjunction with the Association’s delinquency policy.

Your community association is a corporation with a governing body (the Board of Directors) and therefore is required to oversee its business. The Board of Directors currently meet quarterly to review documentation, discuss needs within the community including planning for projects and solving ongoing or potential problems.

You also have these instructions in your New Home Orientation packet given to you at the new Home Orientation, (this is generally seven calendar days before the close of escrow).
